Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Ramona (the “Service”), operated by Ramona (goramona.com) (“we,” “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1. The Service

Ramona is an AI assistant for small businesses. It answers missed calls and texts leads back, captures and qualifies leads, tracks crew hours and payroll, and records job costs and profit — primarily over text message, with a web dashboard at goramona.com. Features may change, improve, or be discontinued over time.

2. Eligibility & accounts

You must be at least 18 and able to form a binding contract. You’re responsible for the information you provide, for keeping your password secure, and for all activity under your account. Notify us promptly of any unauthorized use.

Text and voice features are delivered through third-party carriers and providers. You’re responsible for how you use them with your own contacts, including honoring opt-out requests (such as STOP). Message delivery depends on carriers and networks and isn’t guaranteed.

6. Acceptable use

You agree not to: reverse engineer, resell, or copy the Service; interfere with its operation or security; access it through automated means except as permitted; upload malware; or use it to violate any law or third-party right.

7. AI & automated content

Ramona uses AI to interpret messages and generate replies, summaries, and figures. AI output can be inaccurate or incomplete. You’re responsible for reviewing anything important (such as a quote, an expense, or a payroll total) before relying on or acting on it.

8. Intellectual property

The Service, including its software, design, and content, is owned by Ramona and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service while your account is active. You retain ownership of the business data you put into Ramona, and you grant us the rights needed to operate the Service for you.

9. Third-party services

The Service relies on third parties (such as Twilio, Stripe, Anthropic, SendGrid, and our hosting provider). Their availability and terms are outside our control, and we’re not responsible for their acts or omissions.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We don’t warrant that the Service will be uninterrupted, error-free, or secure, or that any message or call will be delivered, received, or answered. Ramona is a tool to assist you — it is not a guarantee that you’ll capture every lead or never miss a call.

11. Limitation of liability

To the fullest extent permitted by law, Ramona and its operators won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three (3) months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Ramona and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or of any law or third-party right — including claims from people you contacted through the Service.

13. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to us. On termination, your right to use the Service ends; some provisions (such as Sections 8, 10, 11, and 12) survive.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts located in Ontario will have jurisdiction, subject to any non-waivable rights you have under local law. (Update this if your business operates from a different jurisdiction.)

15. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll change the “Last updated” date above. Continued use of the Service after an update means you accept the revised Terms.
